No Fee Unless We Win
No Attorney’s Fees or Case Costs Unless You Get a Settlement
After an accident, you should not have to take on additional financial risk just to pursue justice. At Biazzo Injury Law, we handle personal injury cases on a contingency-fee basis.
That means:
- You pay no attorney’s fee upfront.
- You are not billed by the hour.
- We advance the costs needed to pursue your case.
- You owe no attorney’s fees or case costs unless we recover compensation for you.
If your case does not result in a settlement or other financial recovery, you will not owe Biazzo Injury Law an attorney’s fee or reimbursement for the case costs we advanced, provided you remain represented by the firm through the conclusion of the matter.
We Only Get Paid When You Do
Our attorney’s fee is calculated as a percentage of the compensation we recover for you. The percentage and all financial terms are explained in the written representation agreement before you hire us.
A recovery may include compensation obtained through:
- An insurance settlement
- A negotiated resolution
- Mediation
- Arbitration
- A court judgment
- A jury verdict
- Another enforceable financial recovery
If no compensation is recovered, you owe us nothing for attorney’s fees or case costs, subject to the terms of your written agreement concerning the transfer of your case to another attorney.
No Upfront Attorney’s Fees
Accident victims are often already facing medical bills, lost income, vehicle repairs, and other unexpected expenses. You should not also have to pay an attorney by the hour while your claim is pending.
When Biazzo Injury Law accepts your personal injury case:
- You do not pay an upfront attorney retainer.
- You do not receive monthly legal bills.
- You do not pay hourly attorney’s fees.
- You do not pay case costs as the case progresses.
- Our attorney’s fee and advanced case costs are paid only from a successful recovery.
If we are unsuccessful and no compensation is recovered, you will not be responsible for those attorney’s fees or advanced case costs.
We Advance the Costs of Pursuing Your Claim
Personal injury cases may require expenses to properly investigate, document, and pursue the claim. Depending on the case, these expenses may include:
- Medical records and billing statements
- Accident or incident reports
- Court filing fees
- Deposition expenses
- Expert witness fees
- Medical evaluations
- Investigative services
- Evidence preservation
- Other litigation-related expenses
Biazzo Injury Law advances approved case costs while we handle your claim. When compensation is recovered, those costs are reimbursed from the recovery as provided in the written fee agreement.
When no compensation is recovered, you do not owe us reimbursement for those costs, unless you end our representation and transfer the case to another attorney under circumstances addressed in the representation agreement.
The Transfer-to-Another-Attorney Exception
Our no-fee and no-cost promise applies when Biazzo Injury Law represents you through the conclusion of your claim.
If you choose to terminate the firm’s representation and transfer your case to another attorney, you may be responsible for reimbursing Biazzo Injury Law for costs advanced on your behalf. The firm may also have rights concerning the reasonable value of legal services already performed, as described in the written representation agreement and permitted by applicable law.
We explain this provision before representation begins so that you understand the terms from the outset.
What “No Fee Unless We Win” Means
For purposes of this guarantee, a “win” means that we obtain a settlement, judgment, verdict, or other financial recovery for you.
If we recover compensation:
- Our attorney’s fee is paid from the recovery.
- Advanced case costs are reimbursed from the recovery.
- Medical bills, liens, or reimbursement claims may also need to be resolved.
- You receive the remaining net proceeds after authorized deductions.
If we do not recover compensation:
- You owe no attorney’s fee.
- You owe no reimbursement for advanced case costs.
- The only exception concerns circumstances in which you terminate our representation and transfer the matter to another attorney, as provided in the written agreement.
Clear Terms and No Surprises
We believe clients should understand the financial terms of representation before signing an agreement.
Before you hire Biazzo Injury Law, we will explain:
- The contingency-fee percentage
- How the attorney’s fee is calculated
- Which case costs the firm may advance
- How costs are reimbursed after a successful recovery
- What happens if no compensation is recovered
- What happens if you transfer the case to another attorney
- How medical liens and other authorized deductions may affect the final distribution
All terms of representation will be stated in the written agreement between you and the firm.
